TERMS OF SERVICES
1. Authority, By using Spotless Cleaning Services, you agree that you have the legal authority to enter into this agreement. You represent and warrant that you are of legal age and have the legal capacity to engage Spotless Cleaning Services for cleaning services.
2. Services, Spotless Cleaning Services provides residential and commercial cleaning services. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
3. Solicitation, of Our Cleaners and Employment Practices Clients agree not to solicit, hire, or engage any of our cleaners for any direct or indirect employment or services outside of Spotless Cleaning Services. Violation of this term will result in a referral fee of $3,000.
4. Your Account, You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. Spotless Cleaning Services reserves the right to terminate accounts, refuse service, remove or edit content, or cancel orders at our sole discretion.
5. Electronic Services and Licenses By using our electronic services, you grant Spotless Cleaning Services the right to communicate with you electronically. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
6. Rights You Grant Us You grant Spotless Cleaning Services a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display any content you submit to us for the purpose of operating and promoting our services.
7. Privacy and Security, We prioritize your privacy and take reasonable measures to protect your personal information. However, you acknowledge that no data transmission over the internet is entirely secure, and we cannot guarantee the absolute security of your information.
8. Data Charges and Mobile Phones, You are responsible for any data charges incurred through the use of our services on your mobile phone. Spotless Cleaning Services is not liable for any such charges.
9. Third-Party Entities, Our services may include links to third-party websites or services. Spotless Cleaning Services is not responsible for the content, privacy policies, or practices of any third-party websites or services.
10. Modifying the Services and Termination, Spotless Cleaning Services reserves the right to modify or terminate our services at any time, with or without notice. You agree that we are not liable to you or any third party for any modification, suspension, or discontinuation of our services.
11. Indemnity, You agree to indemnify and hold harmless Spotless Cleaning Services, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of our services or violation of these Terms of Service.
12. Disclaimers, Spotless Cleaning Services provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, accuracy, or reliability of our services.
13. Limitation of Liability, Spotless Cleaning Services is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim arising from your use of our services is limited to the amount paid by you for the services in the preceding three months.
14. Dispute Resolution, All disputes arising from these Terms of Service or your use of our services shall be resolved through binding arbitration, except for disputes that qualify for small claims court.
A. Small Claims Court You may bring any claims in small claims court in Davidson County, Tennessee if the claims qualify.
i. Arbitration Rules The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Consumer Arbitration Rules.
ii. Additional Rules for Non-appearance Arbitration The arbitration shall be conducted by telephone, online, or based solely on written submissions, as chosen by the party initiating the arbitration.
iii. Arbitration Fees All AAA fees for arbitration will be split equally between the parties.
iv. Authority of the Arbitrator The arbitrator will have the authority to grant any remedy that would be available in court, except that the arbitrator's award must be consistent with these Terms of Service.
v. Opt-Out You may opt out of the arbitration provision by sending a written notice to Spotless Cleaning Services within 30 days of accepting these Terms of Service.
vi. Waiver of Jury Trial in Favor of Arbitration You agree to waive any rights to a jury trial in favor of arbitration.
vii. Right to Waive Any rights and limitations set forth in this arbitration agreement may be waived by the party against whom the claim is asserted.
C. Great Clean Guarantee, Spotless Cleaning Services guarantees a high-quality clean. If you are not satisfied with our service, please contact us within 24 hours, and we will re-clean the area at no additional charge.
D. Safety, For the safety of our staff and your property, we ask that all valuables be secured and that pets are kept in a safe area during the cleaning service.
E. Cancellation Policy, Cancellations made within 24 hours of the scheduled service will incur a $50 cancellation fee. Please contact us as soon as possible to reschedule or cancel your appointment.
F. Damages / Missing Items, Spotless Cleaning Services is not responsible for any damages or missing items unless it is proven that our staff caused the damage or loss intentionally. Please report any issues immediately.
G. Pricing and Discounts, We offer competitive pricing and various discounts, including recurring service discounts ranging from 10-30%. Prices are subject to change, and clients will be notified in advance of any adjustments.
Spotless cleaning services charges sales tax of 9.75% and a 3.2% Trust and safety fee( this fee helps pay for spotless cleaning services provider vender.
H. Refund Policy, We do not offer refunds, but we are happy to review and address any claims. If you are dissatisfied with our service, please contact us, and we will work to resolve the issue.
I. Payments Please note that a pre-authorization will be processed before the start date of the services to confirm the availability of funds and ensure the services can be performed the next day.
J. Please note that a trust and safety fee will be charged, and this amount will include all applicable taxes.
By using Spotless Cleaning Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
